Terms of Service
Last updated: 29 October 2026
1. Definitions and scope
1.1. "Bardstar", "we", "us" and "our" mean Bardstar, together with its owners, founders, operators, directors, officers, employees, contractors, agents, licensors, suppliers, service providers, successors and assigns.
1.2. "Services" means, without limitation and in the broadest sense possible: (a) the website at bardstar.com and every subdomain (including dl.bardstar.com), webpage, file, form, image, script, feed, download, update feed and resource served from or under it; (b) all of our desktop software for macOS, including sQuit, xTab and any future application, in every version, build, beta, preview, update, patch and installer (the "Software"); (c) our licence keys, licensing and activation systems, update systems, email communications and support; (d) our security reviews, testing, reports, fixes, calls and related services; and (e) any other product, feature, content or service we offer now or in the future.
1.3. "You" and "your" mean every person or entity that accesses or uses any Service in any way, including visitors who merely load a webpage.
1.4. "Content" means all text, graphics, logos, icons, names, sounds, code, models, prompts, interfaces, designs, layouts, animations, data, statistics and all other materials in or associated with the Services, and all output produced by the Services.
1.5. Headings are for convenience only and do not limit any provision. The words "including", "includes" and "such as" always mean "including without limitation". Any provision that could be read broadly or narrowly shall be read broadly in our favour.
2. Acceptance by use; binding agreement
2.1. These Terms form a binding legal agreement between you and Bardstar. Your agreement is given automatically and conclusively the moment you first access or use any Service, whether or not you have read these Terms, scrolled to the bottom of this page, clicked any button, or created an account.
2.2. Each additional use of any Service, including each launch of the Software and each automatic update, is a fresh and separate acceptance of these Terms as they then stand.
2.3. You confirm that you have had every opportunity to read these Terms, that you understand them, that you have had the opportunity to obtain independent legal advice, and that you waive any argument that any term is unclear, hidden, surprising or was not brought to your attention.
2.4. Our Privacy Policy is incorporated into and forms part of these Terms.
2.5. If you use a Service on behalf of a company, organisation or other person, you represent that you have authority to bind them, and they are bound as well as you.
3. We may change everything, at any time
3.1. We may, at our sole and absolute discretion, at any time and for any reason or no reason, with or without notice to you: (a) amend, replace, add to or delete any part of these Terms; (b) change, suspend, limit, remove or discontinue any Service, or any part, feature, model, language, integration, plan or limit of it; (c) change prices, plans, trial lengths, free-tier limits, device limits and what each plan includes; and (d) stop offering or supporting any Software, operating system version or platform.
3.2. Changes take effect immediately upon being made or posted. It is your sole responsibility to check this page for changes each time before you use any Service. Continued use after any change is your binding acceptance of the changed Terms. If you do not accept a change, your only remedy is to stop using the Services and uninstall the Software.
3.3. We have no obligation to maintain, support, update, fix, host, or keep any Service available for any period, at any performance level, or on any device, platform or operating system.
4. Eligibility
4.1. You may use the Services only if you: (a) are legally able to enter into a binding contract in your jurisdiction; (b) are at least 13 years old, and at least the age required by law in your country to use online services of this kind without parental consent; and (c) if you are under the age of majority where you live, have the permission of a parent or legal guardian who has read and agreed to these Terms on your behalf.
4.2. A parent or guardian who permits a minor to use the Services is fully responsible for the minor's use, for all purchases made, and for any liability arising from that use, and agrees to these Terms personally.
4.3. We do not knowingly permit use by persons who do not meet these requirements. Any such use is unauthorised, entirely at the user's and their guardians' risk, and creates no duty on our part.
4.4. You are responsible for ensuring that your use of the Services is lawful in your location. We make no representation that the Services are appropriate or available anywhere.
5. Licence to use the Services — a licence, not a sale
5.1. The Software is licensed, not sold. Subject to your continuous, strict compliance with these Terms (and, for paid features, full payment of all fees), we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the Software in executable form, on computers you own or control, solely in the form we provide it.
5.2. This licence is automatically and immediately revoked, without notice, if you breach any provision of these Terms, or at any other time at our sole discretion. On revocation you must immediately stop using the Services and uninstall and delete all copies of the Software.
5.3. All rights not expressly granted to you are reserved by us. Nothing in these Terms transfers any right, title or interest to you by implication, estoppel or otherwise.
6. Licence keys, devices and activation
6.1. Paid features are unlocked with a licence key or similar credential. A licence key is personal to the purchaser, is a revocable permission and not property, and may be used only on the number of computers stated for your plan at the time of purchase (Pro licences work on up to three computers at once).
6.2. You must keep your licence key confidential. You may not share, publish, sell, resell, transfer, give away, pool or otherwise make your licence key available to anyone else. You are responsible for all use of your key.
6.3. The Software may contact our licensing systems to activate, verify or deactivate a key. We may deactivate, limit or revoke any key, at any time, without notice or refund, if we suspect sharing, resale, fraud, a chargeback, abuse, or any breach of these Terms.
7. Ownership; all rights reserved
7.1. We and our licensors own, exclusively and absolutely, all right, title and interest, throughout the universe and in perpetuity, in and to the Services and all Content, and all intellectual property and proprietary rights in them, including copyrights, trademarks, trade names, logos, trade secrets, patents, designs, databases and know-how.
7.2. "Bardstar", our logos and marks, and the names of every app and Service are our trademarks. You may not use them, or anything confusingly similar, without our prior written consent.
7.3. Everything is ours. All in-app statistics, plan status, settings formats and similar in-app data or features are a limited licence to you only, have no monetary value, confer no ownership, and may be changed, reset or removed at any time without compensation.
7.4. You waive, and agree not to assert, any claim of ownership, co-authorship, moral right, compensation or credit in respect of any Content or any part of the Services, including anything derived from your feedback or suggestions.
8. Your submissions and feedback — broad licence to us
8.1. If you submit, post, send or enter anything to us or through our websites (including contact form entries, email messages, feedback, ideas, suggestions, feature requests, bug reports, crash reports, logs and screenshots) ("Submissions"), you automatically grant us and anyone we designate a worldwide, perpetual, irrevocable, royalty-free, fully paid, transferable and sublicensable licence to use, copy, store, modify, adapt, publish, translate, create derivative works from, distribute, display and otherwise exploit those Submissions in any form, media or technology, for any purpose, without notice, credit or compensation to you. This section 8.1 does not apply to client material for a security review (see section 23) or to the content of messages you send us through our contact form, which we use only to reply to you.
8.2. Any idea, suggestion or feedback you give us is non-confidential and we may use it freely without any obligation to you. We have no obligation to review, keep, return or respond to any Submission.
8.3. You represent and warrant that you own or control all rights in your Submissions necessary to grant this licence, and that they are lawful and infringe no third-party right. You waive any moral rights in them to the fullest extent permitted by law.
8.4. This section does not give us rights to your content. Our handling of personal data is described in our Privacy Policy.
9. Prohibited conduct — what you must not do
You agree not to do, attempt to do, assist, encourage, or permit any of the following, in relation to any Service, at any time:
- copy, reproduce, distribute, publish, sell, resell, rent, lease, lend, sublicense, transfer, mirror, frame, host or commercially exploit any Service or Content, in whole or in part, except as expressly permitted in these Terms;
- decompile, disassemble, reverse engineer, decrypt, deobfuscate, extract source code, models, prompts, data or algorithms from, or otherwise attempt to discover the workings of, any Service, except to the extent that applicable law expressly forbids this restriction;
- modify, patch, hook, inject code into, tamper with, repackage, re-sign, redistribute, clone or create derivative works of any Software or installer;
- crack, bypass, disable, emulate or circumvent any licence key, activation, device limit, trial, usage limit, free-tier limit, payment check, update check or other technical protection, or generate, distribute or use unauthorised or counterfeit licence keys;
- share, publish, sell, trade or pool licence keys or accounts, or use one licence beyond the number of devices it allows;
- abuse the free plan, trials or promotions, including by resetting trials, reinstalling or using multiple identities, email addresses, devices or virtual machines to obtain more free usage than one genuine user would get;
- scrape, crawl, spider, harvest, mine or systematically collect any data or Content from any Service by automated or manual means, including for the training, fine-tuning, evaluation or benchmarking of any artificial intelligence or machine learning system;
- interfere with, disrupt, overload, probe, scan, test the vulnerability of, breach or circumvent the security, authentication, rate limits or access controls of any Service or any network or server connected to it, including our update feed and download servers;
- introduce any virus, malware, harmful code or disruptive material, or distribute any modified or unofficial build of our Software;
- use any Service to create, send or type anything unlawful, fraudulent, defamatory, harassing, hateful, infringing, deceptive or otherwise objectionable in our sole judgment;
- impersonate any person, misrepresent your identity, age or affiliation, or falsely imply endorsement by or association with us;
- register a domain name, social media handle, app name, store listing or business name that is identical or confusingly similar to ours, or that imitates our names, marks or the look and feel of our Services;
- initiate a chargeback or payment dispute for a charge you authorised, or otherwise commit payment fraud;
- use any Service for any unlawful, harmful or unauthorised purpose, or in violation of any law, regulation, sanction or third-party right;
- use any Service in a way that, in our sole and unreviewable discretion, is inappropriate, harmful to us, other users or third parties, or contrary to the spirit of these Terms; or
- help or attempt to help any other person to do any of the above.
Whether conduct breaches this section is decided by us in our sole and final discretion.
10. Accessibility and other device permissions
10.1. The Software may ask for access to Accessibility, screen or input-monitoring features (so it can detect your shortcut and work with your windows and apps), to the name of the app in focus, and to network access. You alone decide whether to grant each permission, and you can revoke it in your operating system settings at any time; some features will not work without it.
10.2. By granting permissions you accept that the Software will, while active, watch for its shortcuts and act on the windows and apps you use. You are solely responsible for where and when you use it and for any effect on your other software, documents or data.
10.3. Use of the Software consumes processing power, memory, battery, storage and network data. All resulting costs and effects are yours.
11. Updates
11.1. The Software may check for, download and install updates automatically, and we may push updates at any time, including updates that add, change or remove features, change limits, or are required to keep using the Software. You consent to receiving and installing them. We may stop supporting older versions at any time.
11.2. Updates and other downloads are provided under these Terms unless they come with their own terms.
12. Free plan, trials, subscriptions and payments
12.1. Free plan. Some Software includes a free plan with usage limits . Free-plan limits, features and availability may be changed, reduced or withdrawn at any time.
12.2. Trials. A free trial gives temporary access to paid features. It does not require a payment method and does not convert into a paid subscription unless you choose to buy one. When a trial ends, paid features stop and you return to the free plan (if any). One trial per person; trial terms may change at any time.
12.3. Subscriptions. Some paid plans are sold as subscriptions billed in advance, monthly or yearly as you choose; others are one-time purchases. SUBSCRIPTIONS RENEW AUTOMATICALLY AT THE END OF EACH BILLING PERIOD, AND YOUR PAYMENT METHOD WILL BE CHARGED THE THEN-CURRENT PRICE, UNTIL YOU CANCEL. You may cancel at any time; cancellation takes effect at the end of the current billing period, and you keep paid features until then. We do not provide partial or pro-rated refunds for unused time.
12.4. Payments. Payments are processed securely. By purchasing, you authorise us to charge your payment method for all fees, taxes and renewals. We do not store your full card details. You must keep your payment details current.
12.5. Prices. We may change prices, plans and what they include at any time. Price changes apply from your next billing period after the change is posted or notified to you; if you do not accept a change, you must cancel before it takes effect.
12.6. No refunds. ALL FEES ARE NON-REFUNDABLE, IN WHOLE OR IN PART, INCLUDING FOR PARTIAL PERIODS, UNUSED TIME, DOWNGRADES, DISSATISFACTION, OR FEATURES THAT ARE CHANGED OR REMOVED, EXCEPT WHERE A REFUND IS REQUIRED BY MANDATORY APPLICABLE LAW OR IS EXPRESSLY PROMISED ON THE PAGE OR IN THE SIGNED AGREEMENT FOR THE SERVICE YOU BOUGHT. Any refund we choose to give is a one-off courtesy and creates no obligation for the future.
12.7. Digital content and withdrawal. The Software and paid features are digital content supplied immediately upon purchase. To the extent permitted by law, by purchasing you expressly request and consent to immediate supply, and you acknowledge that you thereby lose any statutory right of withdrawal or cancellation (for example under EU or UK consumer law) that would otherwise apply.
12.8. Chargebacks. If you initiate a chargeback, payment reversal or dispute, we may immediately revoke your licence keys, suspend or terminate your access, and recover from you any amounts, fees and costs we incur. You may not use the Services again until the matter is resolved to our satisfaction.
12.9. Taxes. Prices may exclude taxes. You are responsible for all sales, use, value-added, goods and services and other taxes, duties and charges on your purchases, other than taxes on our income.
13. Third-party services
13.1. The Services may rely on, link to or integrate third-party services, including payment processors, hosting and download providers, AI providers and operating systems. We do not control, endorse or accept responsibility for any of them, their content, availability, accuracy, conduct, privacy practices or terms. You use them entirely at your own risk and you release us from any claims arising from them.
13.2. Names of third-party apps shown on our website are trademarks of their owners and are used only to describe compatibility. No affiliation or endorsement is implied, and we do not guarantee that the Software works with any particular app or version.
14. No warranties — everything is "as is"
14.1. TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES, THE SOFTWARE AND ALL CONTENT AND OUTPUT ARE PROVIDED STRICTLY "AS IS", "AS AVAILABLE" AND "WITH ALL FAULTS", WITHOUT WARRANTY OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, CONDITIONS AND REPRESENTATIONS, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING ANY WARRANTY OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, AVAILABILITY, SECURITY, COMPATIBILITY, PERFORMANCE AND QUIET ENJOYMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING, USAGE OR TRADE.
14.2. WE DO NOT WARRANT THAT ANY SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, FREE OF VIRUSES OR HARMFUL COMPONENTS, OR ACCURATE; THAT DEFECTS WILL BE CORRECTED; THAT ANY AI OUTPUT, FINDING OR FIX WILL BE CORRECT OR COMPLETE; THAT ANY DATA, HISTORY, SETTINGS OR LICENCE WILL BE PRESERVED; OR THAT ANY SERVICE WILL MEET YOUR REQUIREMENTS OR WORK ON YOUR COMPUTER OR WITH ANY OTHER SOFTWARE.
14.3. No advice or information, oral or written, obtained from us or through any Service creates any warranty. Statements on our website about speed, accuracy, privacy, compatibility or time saved are general descriptions, not guarantees. You assume all risk arising from your use of the Services.
15. Limitation of liability
15.1. TO THE FULLEST EXTENT PERMITTED BY LAW, BARDSTAR AND EACH OF ITS OWNERS, FOUNDERS, OPERATORS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, SUPPLIERS AND AFFILIATES SHALL HAVE NO LIABILITY WHATSOEVER TO YOU OR ANYONE CLAIMING THROUGH YOU FOR ANY LOSS, DAMAGE, CLAIM, COST OR EXPENSE OF ANY KIND ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE SERVICES OR THESE TERMS, HOWEVER CAUSED, UNDER ANY THEORY OF LIABILITY, INCLUDING CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, MISREPRESENTATION, STATUTE OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS AND EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
15.2. Without limiting the above, we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or any loss of profits, revenue, business, goodwill, reputation, opportunity, data, documents, history, settings, licences or use; any AI output; cost of substitute goods or services; computer damage or failure; data breaches or unauthorised access; interruptions, bugs, errors or downtime; acts or omissions of any third party; or any event beyond our reasonable control.
15.3. CAP. IF, DESPITE THE ABOVE, ANY LIABILITY OF BARDSTAR IS FOUND TO EXIST, THE TOTAL AGGREGATE LIABILITY OF ALL RELEASED PARTIES FOR ALL CLAIMS OF ANY KIND SHALL NOT EXCEED THE LESSER OF (A) THE TOTAL FEES YOU ACTUALLY PAID TO US FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE THREE (3) MONTHS BEFORE THE FIRST EVENT GIVING RISE TO LIABILITY, OR (B) ONE US DOLLAR (US$1.00).
15.4. You acknowledge that these limitations reflect a fair and reasonable allocation of risk, that we would not provide the Services without them, and that they apply even if you are dissatisfied. Your sole and exclusive remedy for any dissatisfaction with any Service is to stop using it and cancel any subscription.
16. Indemnification
16.1. You agree to defend, indemnify, reimburse and hold harmless Bardstar and each of its owners, founders, operators, officers, directors, employees, contractors, agents, licensors, suppliers, affiliates, successors and assigns (the "Released Parties") from and against any and all claims, demands, actions, proceedings, investigations, liabilities, damages, judgments, settlements, fines, penalties, losses, costs and expenses of every kind (including legal and expert fees), arising out of or relating to: (a) your access to or use or misuse of any Service; (b) any text you send or publish using the Services; (c) your Submissions; (d) your breach of these Terms or of any law or third-party right, including recording-consent and privacy laws; (e) any dispute between you and any third party; and (f) any activity under your licence keys or on your computers.
16.2. We may assume the exclusive defence and control of any matter subject to indemnification, at your expense, and you shall cooperate fully and shall not settle any such matter without our prior written consent. Your obligations under this section survive termination and are not limited by any cap.
17. Release and waiver of claims
17.1. To the fullest extent permitted by law, you fully, irrevocably and unconditionally release, waive and forever discharge the Released Parties from any and all claims, causes of action, demands, rights, damages and liabilities of every kind, known and unknown, suspected and unsuspected, that you now have or may have in the future arising out of or connected with the Services, your use of them, or any third party.
17.2. If you are a resident of California or any jurisdiction with a similar rule, you expressly waive the benefit of California Civil Code section 1542, which states: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party," and any similar law.
17.3. You covenant not to sue or to bring any claim against any Released Party that is released by this section.
18. Suspension, termination and enforcement
18.1. We may, at our sole and absolute discretion, at any time, with or without cause and with or without notice, suspend, restrict or terminate your access to any or all Services, revoke or deactivate your licence keys, block your devices or IP addresses, cancel your subscription, and take any technical, legal or other action we consider appropriate. We are not required to give reasons or to provide any appeal. Termination for breach does not entitle you to any refund.
18.2. You may stop using the Services at any time by cancelling any subscription, uninstalling the Software and ceasing to visit our websites. Stopping does not entitle you to a refund and does not release you from any obligation that arose before it.
18.3. Upon termination for any reason your licence ends immediately and you must uninstall and delete the Software. Sections that by their nature should survive will survive, including sections 1, 3, 6 to 9 and 12 to 23.
18.4. We may investigate suspected violations, cooperate with law enforcement and regulators, and disclose information about you and your use if we believe in good faith that it is necessary or appropriate, including to enforce these Terms, protect any person's rights, property or safety, or comply with any law, order or request.
18.5. Nothing limits our right to seek injunctive or other equitable relief, without posting bond, for any actual or threatened breach of sections 5 to 9, and you acknowledge that damages alone would be an inadequate remedy. Our failure or delay in enforcing any right or provision is not a waiver of it.
19. Governing law, arbitration and class action waiver
19.1. Governing law. These Terms and any dispute, claim or controversy arising out of or relating to them or to the Services (each a "Dispute"), whether in contract, tort or otherwise, are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
19.2. Informal resolution first. Before starting any formal proceeding, you must send written notice of the Dispute to support@bardstar.com, describing it in reasonable detail with your contact details, and must negotiate in good faith with us for at least sixty (60) days.
19.3. Binding individual arbitration. To the fullest extent permitted by law, any Dispute not resolved informally shall be resolved exclusively and finally by binding individual arbitration, before a single arbitrator, under the rules of an arbitral institution we select, seated in the location we designate, and conducted in English. The arbitrator has no power to consolidate claims, to award relief not permitted by these Terms, or to award damages exceeding the limits in section 15. Judgment on the award may be entered in any court of competent jurisdiction. You bear your own costs and fees.
19.4. Class action and jury waiver. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND WE EACH WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN OR BRING ANY CLASS ACTION, COLLECTIVE ACTION, CONSOLIDATED ACTION, MASS ACTION, PRIVATE ATTORNEY GENERAL ACTION OR REPRESENTATIVE PROCEEDING. Disputes may be brought only in your individual capacity.
19.5. Exceptions. We alone may, at our option, bring claims for injunctive or equitable relief, for infringement or misappropriation of intellectual property, for licence-key or payment fraud, or for collection, in any court of competent jurisdiction that we choose, and you consent to the jurisdiction and venue of those courts. If arbitration is found inapplicable to a Dispute, the courts we designate have exclusive jurisdiction over it.
19.6. Time limit. To the extent permitted by law, any claim or cause of action by you arising out of or related to the Services or these Terms must be filed within one (1) year after it arose, or it is permanently barred.
19.7. If this section is found unenforceable in whole or in part as to you, the remainder stays in effect, and the courts we designate shall have exclusive jurisdiction over that Dispute.
20. Legal rights that cannot be waived
Some countries give consumers rights that cannot be lawfully waived or limited by contract. Nothing in these Terms excludes or limits any liability or right that cannot be excluded or limited under mandatory applicable law. Every provision of these Terms applies to the greatest extent the law allows, and where a provision cannot be enforced in full, it shall be enforced to the maximum extent permitted and the rest remains valid.
21. General provisions
21.1. Entire agreement. These Terms, together with the Privacy Policy and any additional terms we post for specific Services, are the entire agreement between you and us concerning the Services and supersede all prior understandings, communications, marketing statements and representations. No other statement or promise, by anyone, binds us unless we confirm it in a signed writing.
21.2. Severability. If any provision is held invalid, illegal or unenforceable, it shall be modified to the minimum extent necessary to make it enforceable, or if that is impossible severed, and the remaining provisions remain in full force.
21.3. Assignment. We may assign, transfer, delegate or sublicense any or all of our rights and obligations under these Terms, and any Service or data, at any time without notice and without your consent, including in connection with a merger, acquisition, financing, sale of assets or change of control. You may not assign or transfer these Terms or any right or obligation under them without our prior written consent.
21.4. No third-party beneficiaries, except the Released Parties, who may enforce these Terms.
21.5. No agency. Nothing in these Terms creates any partnership, joint venture, employment, agency or fiduciary relationship between you and us.
21.6. Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, war, pandemics, government action, power, internet or hosting outages, operating-system changes, cyber-attacks, and acts or omissions of third parties.
21.7. Electronic communications. You consent to receive communications from us electronically, including by posting on the Services, in the Software, or by email. Notices from us are effective when posted or sent. Notices to us are effective only when received at support@bardstar.com.
21.8. Construction and language. These Terms shall not be construed against us as drafter. They are drafted in English, the English version controls over any translation, and you waive any right to have them provided in any other language.
21.9. Export and sanctions. You represent that you are not located in, and are not a national or resident of, any embargoed country, are not on any restricted-party list, and will comply with all applicable export, sanctions and trade laws.
21.10. Remedies cumulative. All of our rights and remedies, under these Terms, at law or in equity, are cumulative.
22. Contact
For any question about these Terms, to report a violation, or for any other legal, billing or support matter, write to support@bardstar.com (see our Support page). This is our only official contact address. We aim to reply within one business day.
23. Security reviews
23.1. What this covers. This section applies when you buy a Bardstar security review (Normal Review, Review Plus or a founding-client review). For a security review, if anything else in these Terms conflicts with this section, this section wins. For security reviews, sections 3, 12.6, 12.7, 14, 15.1 to 15.4, 17, 18.1 and 19.3 to 19.5 do not apply, and the version of this section in force on the day you pay governs your review.
23.2. Authorization. Before any testing, you sign Bardstar's short engagement agreement. By signing it, you confirm that you own the app or hold written authority from its owner to allow the testing, and you name the systems in scope. Bardstar tests only those systems, only during the agreed window, and only on a test copy you provide, unless the agreement expressly allows more.
23.3. Confidentiality. Your code, access, data, findings and report are confidential. Section 8.1 does not apply to them. Bardstar uses them only to perform your review and shares them only with service providers that help perform it, under the same confidentiality.
23.4. Deletion. Bardstar deletes your code, access credentials and test data within 30 days of delivery and confirms this in writing on request. The final report is kept for up to 12 months so it can be used for retests, unless you ask for earlier deletion. A Review Plus retest after day 30 uses fresh access you give us.
23.5. Guarantees. (a) If the report and fixes are not delivered within 48 hours of the window start (a start time agreed in writing, once the agreement is signed and working access to the test copy is in place; the clock pauses while we wait on you), we refund 50% of the fee. (b) If the report contains no Critical or High finding as defined in the report, we refund 50% of the fee. (c) You get a free retest within 30 days of delivery (two free retests within 60 days for Review Plus). (d) If a Critical finding we fixed is exploited in the same way within 30 days of delivery, we fix it free. At most one 50% refund applies per review, and refunds are paid to the original payment method within 7 days. These guarantees are express promises for the purposes of section 12.6 and are not limited by sections 14.3, 15.4 or 21.1.
23.6. No absolute assurance. A review lowers risk. It cannot prove that an app has no vulnerabilities, and we do not promise to find every issue.
23.7. Liability for reviews. For a security review, Bardstar's total liability is limited to the fee you paid for that review. The US$1.00 limit in section 15.3(B) does not apply to security reviews.
23.8. Law for reviews. Security reviews are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Review disputes go to the courts of Ontario. If a signed engagement agreement and these Terms conflict, the agreement wins.
23.9. What "fixes" means. Ready-to-merge code for every Critical and High finding, and exact fix steps for Medium and Low findings. A problem that needs a redesign gets a written plan at no extra charge.
23.10. Apps bigger than one review. One review covers one app: one frontend and the backend it uses. If you paid and your app turns out bigger, we agree the core flows in writing or refund you in full, your choice.
